These Terms of Use (“Terms”) govern your use of the Overhead mobile app (“Overhead,” “we,” “us”). By downloading or using Overhead, you agree to these Terms. If you do not agree, do not use the app.

The service

Overhead is an informational app for aviation enthusiasts that notifies you when commercial flights pass near a location you choose. Flight, route, aircraft, and weather information is provided by third-party data sources and may be delayed, incomplete, or inaccurate. Overhead is for general interest and entertainment only and must not be relied upon for navigation, safety, operational, or emergency purposes.

Your account

You are responsible for keeping your account credentials secure and for activity that occurs under your account. You must provide accurate information and be at least 13 years old to use Overhead.

Acceptable use

You agree not to misuse the app, including by attempting to disrupt or reverse-engineer the service, accessing it through unauthorized means, or using it in violation of any law.

Overhead Pro subscriptions

Overhead offers an optional auto-renewable subscription, “Overhead Pro,” that unlocks additional features. The following terms apply to subscriptions purchased through the Apple App Store:

• Billing. Payment is charged to your Apple ID account at confirmation of purchase.
• Auto-renewal. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• Pricing. The subscription price and billing period (for example, monthly or annual) are shown in the app before you purchase.
• Managing & canceling. You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings after purchase. Cancellation takes effect at the end of the current billing period.
• Refunds. Purchases are handled by Apple. Refund requests are subject to Apple’s policies.

Intellectual property

Overhead and its content, branding, and software are owned by us and our licensors and are protected by applicable laws. We grant you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

Third-party data and services

Overhead relies on third-party services for flight, route, aircraft, weather, and subscription functionality. We are not responsible for the accuracy, availability, or practices of those services.

Disclaimers

The app is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, timely, or error-free.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of, or inability to use, the app.

Changes to the service and these Terms

We may modify or discontinue features at any time, and we may update these Terms from time to time. Continued use of the app after changes take effect constitutes acceptance of the revised Terms.

Termination

We may suspend or terminate your access to the app if you violate these Terms. You may stop using the app and delete your account at any time.
